Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Nawarto mobile application and associated web services at nawarto.com (collectively, the "Service"), operated by Nawarto ("we", "us", or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 18, you confirm that you have obtained the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.
2. Account Registration and Security
You access Nawarto using your mobile phone number via one-time passcode (OTP) authentication. You are responsible for:
- Keeping your phone number and device secure
- All activity that occurs under your account
- Notifying us immediately at contact@nawarto.com if you suspect unauthorised access to your account
We are not liable for losses arising from unauthorised access to your account where you have failed to take reasonable steps to keep your credentials secure.
3. Description of the Service
Nawarto allows hosts to:
- Create personalised event invitations with custom text, images, videos, and audio
- Send invitations to guests via our messaging provider
- Collect and manage RSVPs, dietary choices, food allergy information, plus-ones, and notes from guests
- Send event reminders, change notifications, and cancellation notices to guests
- Generate entry barcodes and digital wallet passes; scan guests in at the door
- Designate co-organizers who can view a check-in roster (guest names, RSVP status, plus-ones, dietary choice, and check-in status) and scan guests in at the door. Co-organizers cannot see guests' phone numbers, food allergy information, or private notes to the host, and their access ends shortly after the event
- Allow guests to update their own RSVP via a hosted web link (nawarto.com/rsvp/…)
When an event's RSVP deadline passes, guests who have not responded are automatically marked as not having responded, and RSVP changes for that event are closed.
The delivery of messages depends on a third-party messaging platform outside our control. We do not guarantee delivery, timing, or format of messages.
4. Credits and Payments
Sending invitations requires prepaid credits purchased through the App.
- Purchasing: All purchases are processed by the platform's payment provider. We do not directly handle your payment information.
- Consumption: Credits are deducted when invitations are successfully delivered. Failed deliveries (as confirmed by delivery receipts from our messaging provider) are automatically refunded to your credit balance.
- Follow-up messages: Sending event updates, reminders, or custom messages to guests consumes credits at the rate shown in the App at the time of sending.
- Validity: Purchased credit packs are valid for 3 months from the date of purchase. Unused credits expire and are forfeited after this period.
- Free credits: We may grant a limited number of free credits at our discretion. Free and promotional credits may have an expiry date; unused expired credits are forfeited.
- Refunds: No refunds will be issued for credits you have purchased except as required by applicable law or the platform's refund policies. Refund requests should be directed to the platform through which you made your purchase.
- Price changes: We reserve the right to change credit prices at any time. Changes will not affect credits you have already purchased.
5. Acceptable Use
You agree to use the Service only for its intended purpose of sending private event invitations to people with whom you have a genuine personal or professional relationship. You must not:
- Send messages that violate our messaging provider's policies, applicable anti-spam, marketing, or communications law
- Send unsolicited bulk messages or use the Service for commercial marketing purposes beyond personal event invitations
- Include external hyperlinks in invitation text fields; a location link may only be added in the designated venue link field, and only recognised map or location provider links are accepted there
- Harvest, scrape, or systematically collect guest data beyond your own legitimate event lists
- Upload content that is unlawful, defamatory, obscene, threatening, or infringes any third-party intellectual property rights
- Attempt to reverse engineer, decompile, disassemble, or tamper with any part of the Service
- Probe, scan, or test the vulnerability of the Service or any related infrastructure
- Use the Service through automated scripts, bots, or other non-human means
- Share your account or credentials with others or attempt to access another user's account
- Circumvent, disable, or interfere with any security-related features of the Service
We reserve the right to suspend or terminate accounts that violate these restrictions, without prior notice.
6. Host Responsibilities Regarding Guests
When you add guests to an invitation list, you act as the data controller for their personal data. You are solely responsible for:
- Ensuring you have an appropriate legal basis (e.g. a legitimate interest in hosting a private event, or the guest's consent) to contact each person you invite
- Informing guests that their RSVP, dietary preferences, food allergies, and other responses you collect are stored and used for your event
- Complying with all applicable data protection laws, including GDPR where applicable, in relation to your guests' personal data
- The content of your invitations, including any media (images, video, audio) you upload, which must not infringe any third-party rights or applicable law
We are not responsible for any claim arising from a guest's experience, including messages that are blocked, delayed, or filtered by our messaging provider.
7. User Content
Events, guest lists, messages, images, videos, audio, and other content you create or upload through the Service ("User Content") remain your property. By using the Service, you grant Nawarto a limited, non-exclusive, worldwide licence to store, process, and transmit your User Content solely to the extent necessary to operate the Service (including delivering invitations on your behalf). We do not claim any ownership over your User Content and will not use it for any purpose beyond providing the Service.
You represent and warrant that you own or have the necessary rights and permissions for all User Content you submit, and that doing so does not violate any third-party rights or applicable law.
8. Intellectual Property
All elements of the Service — including its design, interface, code, graphics, text, templates, and the Nawarto name and logo — are owned by or licensed to us and protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our prior written consent.
9. Third-Party Services
The Service relies on third-party platforms including a messaging provider, cloud infrastructure provider, an in-app purchase payment processor, a translation service, and an analytics and diagnostics provider. Your use of those platforms is subject to their respective terms and policies. We are not responsible for the conduct, content, or availability of third-party services.
10. Service Availability and Modifications
We strive to keep the Service available but do not guarantee uninterrupted access. We may, at any time and without prior notice:
- Take the Service offline for maintenance or updates
- Modify, suspend, or discontinue any feature of the Service
- Impose or adjust limits on use (such as the number of guests per event)
We will endeavour to provide advance notice of material changes that may affect your use of the Service. We are not liable for any losses arising from downtime, service modifications, or discontinuation.
11. Account Termination and Data Deletion
You may delete your account through Profile > Delete Account in the App. If you have active upcoming events, you must cancel them first so that your guests are notified. Upon deletion, all your personal data and associated guest records will be permanently erased within 30 days, except financial transaction records which are retained for up to 7 years as required by law.
We reserve the right to suspend or permanently terminate your account, with or without notice, if:
- You violate these Terms or our Acceptable Use policy
- Your use of the Service poses a legal, security, or reputational risk to us or to other users
- We are required to do so by applicable law or a competent authority
12. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that invitations will be delivered within any particular timeframe.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Nawarto, its affiliates, officers, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or loss of goodwill, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of the Service shall not exceed the total amount you paid us in the 12 months preceding the claim.
Nothing in these Terms limits or excludes our liability for fraud, gross negligence, or for any liability that cannot be excluded under applicable law, including consumer protection rights where required by the law of your jurisdiction.
14. Indemnification
You agree to indemnify, defend, and hold harmless Nawarto and its affiliates from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your User Content; (c) your handling of guests' personal data; or (d) any claim by a guest that you lacked an appropriate legal basis to contact them.
15. Changes to These Terms
We may revise these Terms at any time. If we make material changes, we will provide notice through the App or by updating the "Last updated" date above. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
16. Governing Law and Disputes
These Terms are governed by applicable law. We will always attempt to resolve disputes in good faith. If a dispute cannot be resolved informally, it shall be referred to the courts of competent jurisdiction. If you are located in the EEA or UK, nothing in these Terms affects your rights as a consumer under the mandatory laws of your country of residence.
